Procedures in which an arbitration manager acts
An arbitration manager acts within the procedures set out in the Code of Ukraine on Bankruptcy Procedures.
Legal entities
Property administration
The preliminary procedure applied after bankruptcy proceedings are opened. It involves a review of the debtor’s financial position and the recording of creditors’ claims.
Rehabilitation
A procedure aimed at restoring the debtor’s solvency in the manner and within the limits established by the Code.
Liquidation
Applied once the debtor has been declared bankrupt: it includes forming and selling the liquidation estate and settling with creditors in the established order of priority.
Individuals, including sole proprietors
Debt restructuring
A procedure for restoring an individual’s solvency under a restructuring plan approved by the creditors and confirmed by the court. The restructuring manager reviews the debtor’s financial situation, records creditors’ claims and monitors the implementation of the plan.
Debt repayment
Applied if the restructuring plan is not approved or not fulfilled. The realisation manager forms the liquidation estate, arranges the sale of assets at auction and settles with creditors in the manner established by the Code.

Creditors, receivables and asset tracing
Recording creditors’ claims, informing the parties to the procedure, organising meetings of creditors and the creditors’ committee. Identifying and collecting the debtor’s receivables and pursuing claims against its debtors. Tracing, identifying and recovering the debtor’s assets, including by challenging the debtor’s transactions in the manner established by the Code.
