Lifting arrests and encumbrances; registration actions

Arrests and prohibitions may be imposed on different grounds: in enforcement proceedings, as an interim measure in a lawsuit, in criminal proceedings, or as a tax lien. The way to lift an encumbrance depends on its basis, so the work starts by establishing who imposed it, when and why.

FAQ

How do I find out whether my property is under arrest?

Encumbrances on real estate are recorded in the State Register of Real Property Rights, and enforcement proceedings in the enforcement system and the Unified Register of Debtors. Checking the registers is the first step.

Is an arrest lifted automatically after the debt is repaid?

Not always. After repayment the enforcement officer should close the proceedings and lift the arrest, but in practice a separate application and monitoring of register changes are often needed.

How do I get removed from the Unified Register of Debtors?

Debtor records are removed on grounds provided by law, in particular after enforcement proceedings end. Support includes checking the grounds and monitoring removal.

Why check encumbrances before buying property?

Property under arrest, mortgage or dispute may be lost or impossible to re-register. A check helps assess these risks before signing.
