Bankruptcy procedures

An arbitration manager acts in the procedures provided for by the Code of Ukraine on Bankruptcy Procedures: property administration, rehabilitation, liquidation and debt restructuring.

Administration of the debtor’s property

The first stage of bankruptcy proceedings against a legal entity. The arbitration manager analyses the debtor’s financial position, keeps records of creditors’ claims and ensures that meetings of creditors are held.

Rehabilitation

A procedure for restoring the debtor’s solvency under a plan approved in the established manner.

Liquidation

Applied once the debtor has been declared bankrupt. It includes an inventory of assets, forming the liquidation estate and settling with creditors in the order of priority established by law.

Debt restructuring for individuals

An insolvency procedure for a private individual aimed at repaying debts under a plan approved by the court.

Bankruptcy of legal entities and individuals

An overview of the stages and procedure depending on the status of the debtor.

Asset management and realisation

Functions related to the preservation, valuation and sale of the debtor’s assets within the procedure.

Financial analysis

Analysis of the debtor’s financial and business position required for the procedures set out in the Code.

Court costs when filing an application

Amounts are given as of 1 January 2026, in Ukrainian hryvnias (UAH).

SM (subsistence minimum for able-bodied persons): UAH 3,328.

MW (minimum wage): UAH 8,647.

Coefficient 0.8 applies to the court fee rate if the application is filed electronically (via the Electronic Cabinet). This means 80% of the rate, i.e. a 20% reduction.

The arbitration manager’s remuneration is three MW for each month of service and is paid in advance for three months (Articles 30 and 34 of the Code of Ukraine on Bankruptcy Procedures).

The restructuring manager’s remuneration is five SM for each month of service and is paid in advance for three months (Articles 30 and 116 of the Code of Ukraine on Bankruptcy Procedures). Additional remuneration is determined by Article 30 of the Code and is not included in this amount.

* The calculation assumes the application is filed via the Electronic Cabinet. For legal entities, the 0.8 coefficient is applied to the court fee rate.

The SM and MW change over time, so the current amounts should be checked before filing. These amounts are court costs and advance payments of remuneration established by law; they are not the fee for the arbitration manager’s services.
